Activists don't need the personal information of people they disagree with. Terrorists do, charge them accordingly.

[–] Guy_Fieris_Hair@lemmy.world 5 points 4 months ago (1 children)

Terrorist-a person who uses unlawful violence and intimidation, especially against civilians, in the pursuit of political aim

Hmmm.... that DOES sound a bit familiar...

[–] uis@lemm.ee -3 points 4 months ago* (last edited 4 months ago) (1 children)

Terrorism needs target to be an indefinite number of persons.

If target is one particular person, this is regular crime.

EDIT: or persons. Serial killers are serial killers, not terrorists.

[–] explodicle@sh.itjust.works 2 points 4 months ago (1 children)

How many trans people were targeted?

No it doesn’t. But it’s worded in a way that speakers of certain articledeprived languages would have trouble understanding it.

Speak for yourself. If you believe that intelligence work is beneath you, the other side has already won.

[–] 9point6@lemmy.world 4 points 4 months ago (1 children)

10 years seems pretty low for this tbh

[–] FlashMobOfOne@lemmy.world 2 points 4 months ago

Agreed. Handing over personal info is not unlike handing the wrong person a loaded gun.

[–] cultsuperstar@lemmy.world 2 points 4 months ago (1 children)

Just 10 years for violating HIPAA? I would thing it would be longer

[–] Daxtron2@startrek.website 1 points 4 months ago (1 children)

He probably won't get anywhere close to 10 years, if he even gets prison time.

[–] LifeInMultipleChoice@lemmy.world 1 points 4 months ago

Violate a person's rights, slap on the wrist. attempt to overthrow the country, slap on the wrist. Tell the country they shouldn't bomb kids and try to feed them at the same time, added to a terrorist list.

[–] Holzkohlen@feddit.de 2 points 4 months ago (1 children)

And we are revoking his license, right?

[–] meep_launcher@lemm.ee 1 points 4 months ago

At least in this administration.

Don't forget to vote in November. I know we all said we aren't voting for Biden but the realities for project 2025 are beginning to set in.

[–] gndagreborn@lemmy.world 1 points 4 months ago (3 children)

What a clusterfuck of a HIPAA violation.

[–] barsquid@lemmy.world 3 points 4 months ago (5 children)

HIPAA seems to be one of the rare laws that actually results in significant damages. Will be interesting to see the size of the fine on this.

Likely the hospital gets hit as well for allowing him access to medical records on patients he had nothing to do with. Shouldn't have been possible in the first place.

This guy's career is over. I'm sure he'll do okay financially by selling ivermectin to bigoted dimwits, but I doubt he will be practicing real medicine ever again.

[–] roguetrick@lemmy.world 2 points 4 months ago* (last edited 4 months ago) (1 children)

Shouldn’t have been possible in the first place.

I have yet to see a EHR that has access restrictions that would prevent this. Instead it's just logged and if irregular enough you get to have a hostile conversation that could lead to this.

Edit:

Haim, a Dallas surgeon, previously had done some work at Texas Children’s Hospital as part of his residency. The indictment against Haim alleges that in 2023, he asked to reactivate his login there to access information on pediatric patients not under his care, including names, attending physicians and treatment codes, then turned over the information to a media contact.

Okay, that's just dumb. Texas Children's Hospital is going to get fucked over this. Not only did he not have admitting privileges, he didn't even fucking remotely work there. This isn't just a HIPPA violation, it's straight up fraud.

[–] acetanilide@lemmy.world 0 points 4 months ago (1 children)

Yeah when I read that I was like, so all I have to do to get medical records is call and ask? Like I don't even have to have any affiliation apparently.

[–] lightnsfw@reddthat.com 0 points 4 months ago (1 children)

In my experience working hospital IT medical providers can get away with a lot more shit because people try to expedite things for them so they don't have interruptions caring for patients. The places I worked had processes in place to prevent this sort of thing but I had a fuckload of arguments with various middle managers trying to bypass those when a provider bitched that they didn't get what they wanted right away.

[–] acetanilide@lemmy.world 0 points 4 months ago (1 children)

That sounds like a nightmare

[–] lightnsfw@reddthat.com 0 points 4 months ago

Yeah it sucked. Fortunately I'm pretty much immune to that shit when I have something in writing to back my position. They could call me every name in the book, I'm not giving them what they wanted. After awhile it gets kind of entertaining watching them twist themselves into knots when they just have to do what they're told. Especially when they tried emailing my superiors and I could hit them with a reply all explaining in simple terms why I didn't do what they asked and exactly what they needed to do to get it done and have my superiors just be like "yea do that"

[–] snekerpimp@lemmy.world 2 points 4 months ago (1 children)

Correction: his career has changed. He will be taken in as a consultant in some right wing think tank and start shaping the direction of the movement, because he “took action”

[–] ours@lemmy.world 1 points 4 months ago

Or at the very least, get this own alt-right podcast.

[–] gmtom@lemmy.world 1 points 4 months ago (1 children)

Nono, his new career as a right wing mouthpiece is just beginning. He'll be up on stage with MTG and Rittenhouse complaining about cancel culture and how woke has invaded hospitals and how you shouldn't listen to doctors.

[–] MrScruff@lemmy.ml 1 points 4 months ago

Wait what did Magic: The Gathering do?

[–] queermunist@lemmy.ml 1 points 4 months ago

Until it's appealed to the Supreme Court 🙃

[–] HonkTonkWoman@lemm.ee 1 points 4 months ago

Don’t jinx us now… there are plenty of idiots in Washington willing to pay idiots to say the things they want said.

I’d wager this asshole would be willing to say a lot.

[–] DragonTypeWyvern@midwest.social 1 points 4 months ago

Actual and deliberate HIPAA violations meant to cause harm, mind you, not what a brainless antivaxxer thinks is a HIPAA violation.

[–] PM_Your_Nudes_Please@lemmy.world 1 points 4 months ago

Multiple violations, because he released multiple patients’ info. Off the top of my head, I believe it’s up to $250k and 10 years per violation, but the jail time could be served concurrently instead of consecutively.

[–] BonesOfTheMoon@lemmy.world 1 points 4 months ago

I hope for everything he deserves and more, conservatives are freaks of nature.

[–] Gingerlegs@lemmy.world 1 points 4 months ago

Rot in hell, asshole

[–] psycho_driver@lemmy.world 1 points 4 months ago

Face so punchable. He'll be popular in prison.

[–] Streetlights@lemmy.world 1 points 4 months ago (2 children)

For what possible purpose would he need medical records? It can't be money surely.

[–] snekerpimp@lemmy.world 2 points 4 months ago

For finding and eliminating the “vermin” the orange shit stain keeps screaming about.

So, are all conservatives blood lusting, self centered, self absorbed ass holes?

[–] norimee@lemmy.world 0 points 4 months ago (1 children)

It's not about the details of care, but the general information on who is transgender and who was providing or was involved in the care.

With the purpose to "cause malicious harm" as the article says. Which means, they will harass and try to scare involved parties into hiding, leaving or stopping to provide care.

This Conservative activist already published the information to discredit the children's hospital, create a scandal on how they are harming children with the goal that the hospital will stop providing care in fear of bad press.

Their goal is to scare every trans person back deep into the closet (or to leave) and to scare all possible care out of existence, even when legal.

The basic motive is HATE. Plain and simple. Hate of that what is different and the need to control the people around them to live by their beliefs and moral standards.

[–] Streetlights@lemmy.world 0 points 4 months ago (1 children)

Thank for taking the time to lay that out for me. I am unable to comprehend the motives, but that at least starts to explain it. Unthinkable.

Dude forgot his hippocratic oath.

[–] Pronell@lemmy.world -1 points 4 months ago* (last edited 4 months ago)

Doctors tend to not take that oath any longer. Too much of what they do constitutes 'doing harm', seriously.

"Some say that the oath is irrelevant in modern medical practice because it does not address ethical issues that are relevant today."

Editing to clear this up: I mean insurance companies stopping them from helping their patients and not giving them enough time to accurately diagnose their patients. Just to be clear I'm not talking about gender affirming care or abortion.

[–] shield_gengar@sh.itjust.works 1 points 4 months ago (2 children)

Facing possible jail in Texas isn't exactly a price being paid, is it?

[–] JJROKCZ@lemmy.world 1 points 4 months ago (2 children)

Compromising PII is a hipaa violation, that isn’t taken lightly anywhere. He may not get the full 10 years but he will be slapped for this.

[–] shield_gengar@sh.itjust.works 1 points 4 months ago

What I mean is even if he was facing the death penalty or 1 billion years in prison, he hasn't paid, has he. The penalty has been added to cart.

Tangent: I have no faith in the American justice system, much less in any red state's "justice" system. He'll get slapped...on the wrist...using some mental gymnastics about whistleblowers or something like that.

[–] norimee@lemmy.world 1 points 4 months ago (2 children)

Will he loose his licence for this? Because he should. Anyone leaking patient data on purpose should never have access again.

[–] masinko@lemmy.world 1 points 4 months ago* (last edited 4 months ago)

Iirc, his license to practice is the decision of the medical board, not the courts.

I'm not a lawyer, but I think if the courts find him guilty, the courts decide the fine and jail time. But if the medical board finds HIPPA violations, they decide what happens to his medical license.

He can potentially beat the court charges because many courts have been stacked to be hard-line/alt right wing from Trump's appointment of judges. But that's different from the board.

[–] roguetrick@lemmy.world 1 points 4 months ago

A felony conviction will result in him being unable to practice for sure.

[–] FlashMobOfOne@lemmy.world -1 points 4 months ago (1 children)

I dunno, man. Texas is a human rights violator through their prison system. I imagine it won't be a picnic.

[–] EvacuateSoul@lemmy.world 1 points 4 months ago

Yes, they grow their own food and make their own clothes, so after a day of hand picking cotton, you get to rest in your cell with no A/C.

Not all of them are self suffcient in this way, but it is not easy time at all.
