Filmed his TV using his phone in portrait mode. Just as Todd intended it to be.
When the first gameplay video of Tears of the Kingdom leaked, people complained how bad the person was playing and that they basically had the gaming abilities (and temper) of a child.
People who leak those super games do this precisely because they are not smart. This person here is probably not smart enough to even consider recording in landscape mode.
Also they are going to get their ass sued off by Bethesda/Microsoft.
Has that ever happened? Feels extremely unlikely.
Worst case (if you leak this close to launch, otherwise good luck) is you getting fired if you work at the game company.
It all depends on how you got the game. If it was sent early, by accident etc they can't do anything to you. You didn't sign an NDA so you can stream as much as you want, sure they will ban you but they can't sue you since you legitimately got the copy.
